Storytime Terms of Use

1. Introduction
Welcome to Storytime.fm, a generative storytelling platform operated by ALEGRIA VENTURES SERVIÇOS ADMINISTRATIVOS LTDA ("we", "us", or "our"). These Terms of Use ("Terms") govern your access to and use of the Storytime app ("App") and our website, www.storytime.fm ("Website"), including any related services provided by us. By accessing or using our App or Website, you agree to be bound by these Terms. If you do not agree with these Terms, please refrain from using our App and Website.

By accessing or using our App or Website, you represent and warrant that you have the legal capacity to agree to these Terms. If you are under the age of majority in your jurisdiction, you must have your parent or legal guardian's permission to use the App and Website.
4. Account Registration
4.1. User Information
The App and Website are intended for users of all ages, but we recommend that children under the age of 13 use our services under parental supervision. By accessing or using our App or Website, you represent and warrant that you have the legal capacity to agree to these Terms. 4.2. Account Security

- Ensure that you log out from your account at the end of each session.
- Not create multiple accounts or impersonate others.
We reserve the right to suspend or terminate your account if we suspect any violation of these Terms or unethical use of Storytime.
5. License Grant and Restrictions
5.1. License Grant
Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, non-sublicensable license to:
- Download, install, and use the App on devices that you own or control for personal, non-commercial purposes.
- Access and use the Website for personal, non-commercial purposes.
5.2. Prohibited Activities
You agree not to:
- Copy, modify, or create derivative works of the App or Website.
- Reverse engineer, decompile, or disassemble any part of the App or Website.
- Remove or alter any copyright, trademark, or proprietary notices.
- Rent, lease, lend, sell, sublicense, or redistribute the App or Website.
- Use the App or Website for any unlawful, unethical, or unauthorized purpose.
- Use the App or Website in any manner that could disable, overburden, or impair the services.
- Access or attempt to access any data, systems, or networks without authorization.
- Use any automated means to access the App or Website for any purpose.
5.3. Third-Party Services
The App utilizes APIs and services from third-party providers, including OpenAI, Google, and ElevenLabs, to enable AI-driven story generation. Your use of the App is also subject to the terms and policies of these providers.
6. Content and Intellectual Property
6.1. Ownership of Content
All content created, generated, or provided through the App and Website, including but not limited to text, images, graphics, and user-generated stories (collectively, "Content"), is the property of Storytime or its licensors.
6.2. User Input and Output
- Input: Any material or data you submit to the App, including prompts or ideas.
- Output: Any content generated by the App based on your Input.
By using the App, you acknowledge and agree that:
- Storytime owns all rights, title, and interest in and to the Output.
- You grant Storytime a perpetual, irrevocable, worldwide, royalty-free, and transferable license to use, reproduce, modify, distribute, and display your Input and Output for the purposes of operating, improving, and promoting the App and our services.
6.3. Personal Use License
We grant you a limited, non-exclusive, non-transferable license to use, share, and display the Output for personal, non-commercial purposes. You may share the content you create on social media platforms, provided that you do not:
- Use the Output for commercial purposes without our prior written consent.
- Infringe upon any third-party rights or applicable laws.
- Remove any proprietary notices or disclaimers.
6.4. Feedback
If you provide any feedback, suggestions, or ideas about the App or Website ("Feedback"), you grant us the right to use such Feedback without any obligation to you.
6.5. Copyright Infringement and DMCA Policy
We respect the intellectual property rights of others. If you believe that any content on the App or Website infringes upon your copyright, please notify us at support@storytime.fm with the following information:
- A description of the copyrighted work claimed to have been infringed.
- A description of the infringing material and where it is located.Your contact information.
- A statement that you have a good faith belief that the use is not authorized.
- A statement under penalty of perjury that the information is accurate.
- Your electronic or physical signature.
We will take appropriate action as required by the Digital Millennium Copyright Act (DMCA) and other applicable laws.
7. Misuse of Services

You agree not to use the App or Website to create, upload, transmit, or distribute any content that:

7.3. Enforcement Actions
We reserve the right to take appropriate actions for violations, including:
- Issuing warnings.
- Suspending or terminating accounts.
- Removing prohibited content.
- Taking legal action if necessary.
You are responsible for ensuring that your use of the App and Website complies with all applicable local, state, national, and international laws.
8. Content Filters and Adult Responsibility
While we employ content filters to ensure that stories and images generated within the App are age-appropriate, we cannot guarantee that all content will be suitable for all audiences. Adults are responsible for:
- Reviewing all stories produced by the App before sharing them with children.

We welcome suggestions on how to improve our content filters and make the App safer for all users.
9. Termination
9.1. Termination by Us
We reserve the right to suspend or terminate your access to the App and Website, without prior notice, if we determine, in our sole discretion, that you have violated these Terms or engaged in unethical or unlawful behavior.
9.2. Effect of Termination
Upon termination:
- Your right to access and use the App and Website will immediately cease.
- We may delete your account and any associated data.
- The provisions of these Terms that by their nature should survive termination shall remain in effect.
9.3. Termination by You
You may delete your account at any time by contacting us at support@storytime.fm. Upon receipt of your request, we will take reasonable steps to delete your personal data, subject to any legal obligations.
10. Changes to Terms
We may modify these Terms from time to time. If we make material changes, we will notify you by:
- Updating the "Last Updated" date at the top of these Terms.
- Sending an email notification to the address associated with your account.
- Posting a notice on the App or Website.Changes will become effective immediately upon posting.
Your continued use of the App or Website after the changes become effective constitutes your acceptance of the revised Terms.
11. Governing Law and Dispute Resolution
11.1. Governing Law
These Terms are governed by and construed in accordance with the laws of the State of São Paulo, Brazil, without regard to its conflict of law principles.
11.2. Dispute ResolutionAny disputes arising out of or relating to these Terms or the App and Website shall be resolved through binding arbitration in São Paulo, Brazil, in accordance with the rules of the Brazilian Arbitration Act. Each party shall bear its own costs, and the arbitration award shall be final and binding.
11.3. Class Action WaiverYou agree that any disputes will be conducted only on an individual basis and not in a class, consolidated, or representative action.
12. Limitation of Liability
To the fullest extent permitted by applicable law:
- Exclusion of Damages: Storytime and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, goodwill, or other intangible losses.
- Liability Cap: Our total liability to you for all claims arising out of or relating to these Terms or the App and Website is limited to the amount you have paid us for the services in the twelve (12) months preceding the claim.
13. Disclaimer of Warranties
The App and Website are provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, either express or implied. We disclaim all warranties, including but not limited to:
- Warranties of merchantability.
- Fitness for a particular purpose.
- Non-infringement.
- That the App and Website will meet your requirements or be available uninterrupted, secure, or error-free.
14. Indemnity
You agree to indemnify, defend, and hold harmless Storytime, its affiliates, officers, directors, employees, agents, and licensors from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising from:
- Your use or misuse of the App or Website.
- Your violation of these Terms.
- Your violation of any rights of a third party, including intellectual property rights.
We will provide notice to you of any such claim, suit, or proceeding and may assist you, at your expense, in defending any such claim.
15. Privacy

We may assign or transfer our rights and obligations under these Terms, in whole or in part, without your prior consent. You may not assign or transfer any rights or obligations under these Terms without our prior written consent.
19. Entire Agreement and Severability
These Terms, along with the Privacy Policy and any additional agreements you may enter into with us, constitute the entire agreement between you and Storytime regarding the App and Website. If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
20. Force Majeure
We shall not be liable for any failure or delay in performance due to causes beyond our reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, civil unrest, government actions, strikes, or power outages.
21. Language and Accessibility
These Terms are provided in English, which shall be the governing language. We do not currently provide translations or alternative formats. If you require assistance, please contact us at support@storytime.fm.
22. User Feedback
By submitting Feedback to us, you grant us the right to use such Feedback without any restriction or compensation to you. We may use, reproduce, modify, and distribute the Feedback for any purpose.
23. Updates and Maintenance
We reserve the right to modify, suspend, or discontinue the App or Website, or any part thereof, at any time without notice. We are not liable for any interruptions, errors, or downtime.
